Marina Hawaii Vacations - Terms and Conditions
For the purpose of this Vacation Rental Agreement (this "Agreement"), "Tenant" shall mean the person who is holding a room reservation made with Marina Hawaii Vacations (the “MHV”), to rent a condominium vacation rental unit (the "Unit"). "Tenant", and "Unit" shall be the persons and condominium unit identified in the reservation confirmation email (the "Confirmation Email") received by the Tenant at the conclusion of the booking process. "Tenant" may also be referred to in this Agreement by the terms “Tenant”, "you," "your" and similar terms.
This Agreement is entered into by and between Marina Hawaii Vacations and its future Tenant.
Occupancy: Maximum occupancy limits are strictly enforced as each condo has a specific occupancy limit. Excessive noise, parties, and occupancy violations may result in Honolulu Police Department evictions and fines up to $2,000 per day. MHV reserves the right to terminate occupancy without refund should violations of house rules or occupancy limits occur.
**NO PARTIES, PETS OR SMOKING ALLOWED AT ANY OF OUR PROPERTIES**
Rates: E-Special Rates will be displayed on our website. Peak Season: December 20 till January 3rd. Winter Season: January 4th until Monday after Easter. Spring Season: April 22 until June 15. Summer Season: June 16 until August 24. Fall Season: August 25 until December 19. Rates are subject to Hawaii State Taxes: Hawaii State General Excise Tax at 4.712%, Hawaii Transient Accommodations Tax at 10.25% and Oahu Transient Accommodations Tax at 3% (combined rate of 17.962%). Tax rates are subject to change without notice from the State of Hawaii and the City & County of Honolulu.
Payment Policy: By authorizing credit card payment online you are accepting of the terms and conditions of MHV, a deposit equal to 20% of the reservation is due and payable to Marina Hawaii Vacation at the time of booking your reservation and the same credit card will be charged the remaining balance on the final payment due date. All payments will be in US dollars. We accept most major credit cards.
A non-refundable reservation fee of $50.00 will be added to each reservation. A fee of $35.00 will be charged for all returned checks. Although each property will be completely equipped for rental purposes, we cannot accept responsibility for aesthetic conflicts. We reserve the right to change units for any reason.
Full prepayment is due thirty (30) days prior to arrival. Reservations booked with the NON-Refundable payment policy, are considered non-refundable, no exceptions. **Payments must be made in US Funds only**
Credit Card Authorization & Deposits: Reservations are not confirmed until we receive credit card payment for the 20% deposit and full payment. Payments made by credit card online also authorizes MHV to charge the same credit card if needed for charges that may result from any damages, excessive cleaning, or loss to the property or its contents, caused by the guest during their stay. All deposits shall be held in client trust accounts and any interest earned in said account shall be paid to MHV.
Cancellation Policy: All notices of cancellation either by phone, email or in writing are subject to the following penalties:
- 31 or more days prior to arrival - $50 reservation fee penalty and deposit is forfeited.
- 30-nights prior to arrival: $50 reservation penalty and no refund on your deposit and/or rental payment
No refunds are made for un-used nights regardless of cause. All reservations that need a date and/or property change are subject to availability and MHV’s discretion. Tenant agrees to pay a $50 change fee for any date or property change once a reservation was previously confirmed. Reservations are unit specific; therefore, after the “full payment date” all requests for a unit change are based on availability and are subject to a cancellation fee for the original unit and dates held. To protect your investment, optional Vacation Rental Insurance is available and priced at the time of booking. Should the owner of any property elect to remove their property from our rental program, the guest shall not hold MHV liable. In such an instance, the guest will be relocated to comparable accommodations determined by MHV. If comparable accommodations are not available, the guest will receive a full refund.
MHV is not responsible for events beyond our control, e.g. inclement weather, maintenance issues and strongly suggests that travel insurance be purchased.
Accidental Damage Protection: Tenant agrees to pay a damage waiver of $50 which will be included with all reservations. The peace-of-mind damage waiver will cover accidental damage to rentals units up to $2,000. Damage must be reported by the Tenant before departure. Damage not reported by the tenants will not be covered by the damage waiver and Tenant will be responsible for all expenses incurred. The accidental damage waiver covers unintentional damages to the rental unit interior that occurs by a registered guest provided that the damage was not intentional or any negligence involved. The program will reimburse MHV and or the accommodation owner for the cost of repair or replacement of such property up to a maximum benefit of $2,000.
Housekeeping Service: A check-out cleaning fee will be added to the reservation total. Cleaning service during your stay is available at an additional cost. Your unit will be prepared for your arrival including linens and towels. A starter kit for the kitchen and bathroom is provided and includes the following amenities: dish washing liquid, dishwasher soap, laundry soap, coffee, paper towels and toilet paper. The starter kit is not replenished during your stay.
**Beach Towels are not provided**
Tenant agrees to maintain the cleanliness of the premises during the occupancy and to leave the premises thoroughly clean and in good condition upon departure. Please empty all trash and place all dirty dishes and kitchenware in the kitchen sink prior to your departure.
Maintenance: All of our units are individually owned and decorated. Please do not remove linen, dishes or other items from the unit, as they belong to the owner. Additional charges will be incurred for damages, lost items, or excessive check out cleaning caused by guests during their stay. Repair Issues may arise and should a unit’s maintenance issues make the unit uninhabitable MHV will offer an alternative unit. Refunds or credits are not provided for maintenance issues as long as we are making our best efforts to complete them.
Check-in: Upon receipt of your payment, your reservation confirmation will be emailed to you. Enclosed will be the office address with directions.
Check-In is at 4:00 PM
The Tenant agreeing to these terms must register at the Office on property during business hours and be the responsible occupant for the entire term of the reservation.
The reception office for MHV is located in the lobby of the Ilikai Hotel, across the hallway from “Dave’s Ice-Cream”, 1777 Ala Moana Blvd. Please go up the stairs when you arrive at the front entrance of the Ilkai Hotel, take a left down the hallway and the office is located on the right side.
The office hours are Monday through Friday, 8:00 am – 4:30 pm, Saturday 9:00 am till 1:00 pm, Sunday closed. The office is closed on all major holidays.
The Ilikai Hotel front desk is not affiliated with MHV.
MHV cannot absolutely guarantee specific unit numbers or accommodations and reserves the right to substitute alternate accommodations of a similar type up to and including the day of arrival.
All reservations are subject to change or cancellation for reasons including but not limited to maintenance problems (i.e. plumbing, electric, etc.), strikes, owner requests, sale of unit, changes in State and County Laws, acts of God, or failure of guests to vacate as scheduled.
For any guest arriving after our office hours, we will provide you with after-hours arrival information prior to your arrival.

Check-Out is 11:00 AM.
Unauthorized use of a unit after check-out time will result in a charge of $75/hour. If you require a late check-out and the unit is available, special arrangements can be made with our office 24-hours prior to your departure date. Late check-outs are at $10 per hour.
Key Returns: All keys must be returned to our office prior to departure. If you check-out after our office hours, please drop your keys in our drop box next to our office door. For any keys that are lost/stolen the guest will be responsible for changing the locks and duplication of (6) sets of keys.

All reservations are subject to change or cancellation for reasons including but not limited to maintenance problems (i.e. plumbing, electric, etc.) strikes, owner requests, sale of unit, changes in State and County Laws, acts of God, or failure of guests to vacate as scheduled.
Disclosure: Although we hire professional pest control services your experience in the tropics may include pests, which cannot be completely controlled. Pests include insects, rodents, and friendly geckos. You may also experience dangerous ocean conditions, security issues, and strong sun. There are no lifeguards at the pools or at some beaches. We ask that you be aware of your surroundings and take appropriate precautions.
**MHV is not responsible for lost or stolen items**
Beach Warning: IMPORTANT!! While our beaches are lovely, potential danger exists due to ever-changing ocean conditions. The beach can appear deceptively calm and yet be capable of inflicting severe injury and even death. When you arrive at the beach, look for warning signs and flags. Speak with lifeguards to familiarize yourself with beach conditions (which differ from season to season). BEWARE: Not all beaches have warning signs, flags or lifeguards. Never turn your back on the waves or allow children to play in the water unattended. Please share these precautions with everyone that you are traveling with.
No Smoking Policy: By accepting the reservation and agreeing to the terms and conditions, you acknowledge that you understand MHV’s Non Smoking Policy, including the assessments of a Smoke Elimination Fee in the event of noncompliance. State Law prohibits Smoking (cigarettes, cigars, E-Cigs etc.) in all areas open to the public that include, but are not limited to restrooms, lobbies, reception area, hallways, bars, vacation rental rooms and lanais, restaurants, retail service establishments and retail stores. Thus, all accommodations are Non-Smoking. Persons who smoke, permit smoking or otherwise cause the odor of smoking in a MHV’s managed condominium unit will be assessed a Smoke Elimination Fee of $500.
While this Non-Smoking Policy has been developed in the best interest of our guests, owners and employees, to ensure compliance with State law, please note that MHV does not manage all condominium units in a condominium project and therefore, some units and common areas are not subject to our control.
Pet Policy: No pets allowed - $300 fine
Disclaimer: The Tenant agrees that MHV shall not be liable to the Tenant, Tenant’s guests, invitees or any other person for any injury, loss or damage to any person or property on or about the rental premises. Tenant shall hold MHV harmless and indemnified from and against all loss or damage occasioned by use, misuses or abuse of any part of or fixture on the premises, surrounding areas and from or against any omission, neglect, or default of the Tenant, his/her guests or invitees. The Tenant acknowledges that MHV is acting solely in the capacity of the Agent for the property owner, and assumes no liability thereunder.
Confirmation of your reservation, by authorizing credit card payment online, has deemed acceptance of the terms and conditions.
